Definitions
Agreement The terms and conditions contained in the relevant booking form and these
terms.
- The person entering into this agreement with us by accepting these terms.
- All sites, offices and locations that you and we have agreed are covered by this
agreement.
- The information, know-how, data and any other material we supply to you pursuant
to the Service(s)
- Training and Material relating to a service or services provided to you by us, face
to face, through our web-site or sent to you by e-mail or by any other means. Service
includes any ancillary materials supplied by us.
- The fee for any Service as specified in the booking form, web site or confirmation.
Services
Bookings of Services
Bookings and can be made by completing a booking form online or by telephone, however
telephone bookings must be confirmed in writing. Your booking will be unconfirmed
until we receive your signed booking form and payments, see time frames below.
Payments
Cheques should be made payable to Bystillwaters. Online payments via the e-commerce
process on the web site forms.

Prices
Services, Courses and products will be charged at the price shown on the web site.
We will add reasonable postage and packing for products. We reserve the right to
change any prices without notice. Training courses include tuition, course notes,
and training venue facility. All other charges are the responsibility of the attendee.
Course Enrolment Instructions
On receipt of final payment we will issue a location map, public transport information,
venue details and course timings, via the web site or email. Please ensure your contact
details are correct at the time of booking/purchasing.
Courses, cancellations of and substitutions
Typically, (these prices are for example purposes only) 2 day courses are £350,
discounted to £295 if full payment is received by 6 weeks prior to the course start
date, this is broken down as £95 deposit at the time of booking and the balance
of £200 which is required 6 weeks prior to the course start date.
Transfers / Substitutions
Deposit is required to reserve a place on the course. The DEPOSIT IS NON-REFUNDABLE,
however all funds received, less a £30.00 processing / administration fee, can be
applied to a future workshop/course or product purchases, if transfer is requested
at least
Cancellations
In the event that you require to cancel your booking, it is your responsibility to
ensure that your cancellation information reaches us. When we receive cancellation,
and confirmation is returned to you, it must be in our office at least 4 weeks prior
to the starting date of the course. NO CREDIT will be given for cancellations less
than 4 weeks from the starting date of the course.
Attendance
If you arrive late for a course or are absent from any session, we reserve the right
to refuse to accept you for training if we feel you will gain insufficient skills
or knowledge in the time remaining. No refund will be given. We sometimes video the
courses/workshops to provide, either freely or for compensation, to students, we
reserve the right to do this, if there is any objection to this then please contact
us in writing prior to the course or workshop. We will not pay royalties any any
form to any persons who may be in the video.
Changes
We reserve the right to make changes or improvements to its products or services
at any time without notice.
Restrictions on use
You shall not use the Service or materials for training other therapists or anyone
else.
You will not:
- Alter any part of the Service or the Materials; or
- Contest our intellectual property rights in the Service or the Materials.
- You are not permitted to reproduce or use any of the materials or content of the
courses / workshops, it is, and remains the intellectual property of TMRT Bystillwaters
for any other purpose than for private use in developing the your personal skills
in the pursuit of providing the TMRT services to your customers.
Obligations
- Our obligations are to provide a high quality product that will have value in the
market place. We will present the you the attendee with a Certificate of Attendance
at the end of the course attended. You are, as part of this agreement, to provide
evidence of practice of your TMRT skills in the form of 6 case studies and 6 testimonials
of clients you have worked with after the attendance of the course. You will then
provide those case studies to us, by using the web forms on the www.bystillwaters.org
web site. We reserve the right to contact any of your clients in the case studies
to discuss their experience of TMRT and you as a therapist. Once we are satisfied
that the case studies are of good quality a further certificate will be awarded,
Completion of the Coursework and Training.
- We do not wish to dictate the layout and content format, but they should include:
- name and contact email and telephone contact details of the clients and yourself.
- completed contraindications forms
- a description of the client problem, what approach you took, the outcome and what
if anything you would change in your approach.
- completed client feedback forms
- (We would ask that they be presented to us in MS-Word or PDF)
- You as a minimum meet the pre requisites of the courses, as specified in the course
descriptions and synopses.
- You agree that you have the means to pay for the course and any supplementary fees,
which are expended pursuant to attending the courses.
- It is your responsibility to turn up on time for lessons.
- You confirm that you have the minimum of industry standard liability insurance to
cover for your potential liabilities during the courses / workshops.
Limitation of liability
Our liability to you for any loss or damage is limited to damages of an amount equal
to the Fee.
Under this paragraph, our limits of liability includes that of any company in our
group or member of any of our affiliates and their respective agents, employees and
sub-contractors, your includes any other party claiming through you and loss or damage
includes any losses, damages, costs or expenses whatsoever or howsoever arising in
connection with the Service or training assignments, whether under this agreement
or other agreement or in consequence of any misrepresentation, misstatement or act
of omission, including negligence.
Termination
This agreement will terminate when the Services are complete or if you are in material
breach of any of its terms and if the breach is not remedied within the period of
ten days after we have given you written notice of it.
This agreement is governed by English law and you submit to the non-exclusive jurisdiction
of the English courts.
Disclaimer
Whilst every care has been taken in the compilation of this web site, terms and conditions,
and every attempt made to present up-to-date and accurate information, we cannot

Quality, Description and fit for purpose
Our Video based products are NOT produced with large budgets and production teams
it is our belief, supported feedback from our clients that the content is the crucial
part. We are providing a product that is value for money and fit for the purpose,
providing video based information that supports the interactions between the different
parties; Examples of the video materials are available on the web via you tube.
Product Defects, and returns
Although we work to a quality level that all of our products are sold without defects,
if in the unlikely event that one of our products is defective please contact us
when the defect is found. (It is in both your and our interests this is done ASAP
we recommend no more than 14 days, (Sale of Goods Act 1979) Our first response is
likely to be to replace the defective product, if the product has been used for a
considerable time, we may offer a repair service as a solution.
If not specified, in the description we provide a warranty of 12 months to replace
and or repair any faulty goods.
This agreement is governed by English law and you submit to the non-exclusive jurisdiction
of the English courts.
